5.2 Verification
To prevent unauthorized or malicious deletion of data, we must verify the identity of the person making the request. Upon receiving your email, our security team will initiate a verification process. This may involve:
- Sending a confirmation link to the registered email address.
- Requesting verification of recent invoice numbers or project milestones.
- In the case of enterprise clients, verifying the request with the designated corporate project manager.
We will not process any data deletion request until the identity of the requester has been successfully verified.
6. Deletion Timeline
Once your identity has been verified, BNK Services is committed to executing the data deletion promptly.
- Standard Processing Time: We aim to process and complete all verified data deletion requests within thirty (30) days of the verification date.
- Complex Requests: If the request involves deeply integrated enterprise data or requires dismantling extensive custom software environments, the process may take up to sixty (60) days. In such cases, we will notify you of the required extension within the initial 30-day window.
Upon successful deletion from our active systems, we will send you a final confirmation email.
7. Exceptions and Legal Requirements
While we deeply respect your right to privacy, there are specific, legally and operationally justifiable scenarios where we cannot immediately delete your data.
We reserve the right to deny or delay a deletion request if retaining the data is necessary for us to:
- Complete a Transaction: If you have an active, ongoing software development project or an unpaid invoice, we cannot delete the project data or your billing information until the contract is fulfilled and settled.
- Comply with Legal Obligations: We are required to retain certain financial transaction records, invoices, and tax-related data for a minimum period (typically 7 years) to comply with Indian tax laws and corporate accounting regulations.
- Detect Security Incidents: We may retain specific server logs and IP address records to investigate ongoing cyber-attacks, fraud, or violations of our Acceptable Use Policy.
- Establish Legal Defenses: We may retain communication records and signed contracts if there is an ongoing or reasonably anticipated legal dispute between you and BNK Services.
8. Backup Retention
BNK Services utilizes automated, geo-redundant backups to protect against catastrophic system failures and ransomware attacks.
8.1 How Deletion Affects Backups
When your data is deleted from our “Active Systems,” it is not instantly purged from our “Cold Backups.” It is technically infeasible to individually extract and delete specific user records from encrypted, monolithic database snapshots.
- Your deleted data will remain securely encrypted in our backup archives for a maximum of ninety (90) days.
- After the 90-day retention cycle concludes, the backup snapshot containing your data is automatically overwritten and permanently destroyed.
- If a disaster recovery event forces us to restore an older backup within that 90-day window, our engineering team will manually re-apply your deletion request to the restored database before it goes live.
9. User Responsibilities
When requesting data deletion, you are responsible for:
- Ensuring you have downloaded or backed up any proprietary project assets, codebases, or generated reports you may need in the future, as the deletion process is irreversible.
- Providing accurate and timely responses during our identity verification process to prevent delays.
10. Company Responsibilities
BNK Services is responsible for:
- Handling all data deletion requests with strict confidentiality and technical professionalism.
- Ensuring that deleted data is “crypto-shredded” or otherwise rendered completely unrecoverable using industry-standard wiping tools.
- Communicating clearly with you throughout the timeline of the deletion process.
11. Governing Law
This Data Deletion Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising concerning data privacy rights, compliance, or the execution of this policy shall be handled exclusively within our operational jurisdiction.
12. Updates to Policy
